WAIVER & RELEASE FROM LIABILITY-THIS IS A RELEASE
Instructions:
1. Applicants age 18 and over, please complete Part “A.”
2. Applicants under age 18 must have parents of guardian
complete Part “A” and Part “B.”
Part “A” Waiver and Release from Liability
In consideration of being permitted to enter for any purpose any RESTRICTED AREA (herein defined as the areas to which admission by the general public or spectators is prohibited), or being permitted to compete, officiate, observe, work for, or any purpose participate in any way in the event, EACH OF THE UNDERSIGNED, hereinafter referred to as “releaser,” for himself, his personal representatives, heirs, next of kin, acknowledges, agrees, and represents that he has, or will immediately upon entering any such restricted areas, and will continuously thereafter, inspect such restricted area or areas and his participation, if any, in the event constitutes an acknowledgement that he has inspected such areas and that he finds and accepts the same as being safe and reasonably suited for the purpose of his use, and he further agrees and warrants that if, at any time, he is in or about restricted areas and he fells anything to be unsafe, he will immediately advise the officials of such and will leave the restricted area(s) and further:
1. HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO
SUE the “Lake Dardanelle Big Bass Classic,” the promoters,other participants,
operators, officials, any persons in a restricted area, sponsors, advertisers, owners
and lessees of premises used to conduct the event and each of them, their
officers and employees, all for the purposes hereinafter referred to as “releasee”,
from all the undersigned, his personal representatives, assigns, heirs, and next of
kin for any and all damage, and any claim or demands therefore on account of
injury to the person or property of resolution in death of the undersigned,
whether caused by the negligence of the “releasee” or otherwise while the
undersigned is in or upon the restricted area, and/or, competing, officiating in,
observing, or working for, or for any other purpose participation in the event.
2. HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the
releasees and each of them from any loss, liability,damage, or cost they may
incur due to the presence of the undersigned in or upon the restricted area or in
any way competing, officiating, or working for, or for any purpose participation in
the event and whether caused by the negligence of the releasees or otherwise.
3. HEREBY ASSUMES FULL RESPONSIBILITY OF ANY RISK OF BODILY
INJURY, DEATH, OR PROPERTY DAMAGE due to the negligence of releasees
or otherwise while in or upon the restricted area and/or while
competing, officiating, observing, or working for, or for any purpose
participating in the event.
4. EACH OF THE UNDERSIGNED, expressly acknowledges and agrees that the
activities at the event and in the restricted areas are dangerous and involved the
risk of serious and/or death and and/or property damage. EACH OF THE
UNDERSIGNED further expressly agrees that the foregoing release, waiver, and
indemnity is intended to be as broad and inclusive as permitted by the law of
the Province or State in which the event is conducted and that if any portion
thereof is held invalid, it is agreed that the balance shall, notwithstanding,
continue in full force and effect.
THE UNDERSIGNED HAS READ AND VOLUNTARILY SIGNS THE RELEASE AND WAIVER OF LIABILITY AND INDEMNITY
AGREEMENT, and further agrees that no oral representations, statements, or inducement apart from the foregoing written agreement have been made. This waiver, release and indemnification agreement specifically embraces each and every activity or event in which the undersigned participates so that the parties herein intended to be released and indemnified shall be fully and effectively released and indemnified as to each and every event herein above described.

Rules & Regulations

1. Amateur Fishermen only. If you are considered a professional
fisherman, or the majority of your annual income is received from
tournament prize money, sponsors or other fees related to
fishing, you are ineligible to fish this event.
2. All local, State, Federal, Coast Guard, and Arkansas Game &
Fish regulations shall apply and must be observed at all times
during the tournament.
3. All contestants must wear a Coast Guard approved life vest
attached to a working kill switch when outboard engine is running.
All boats must be equipped with an operating live well. No alcoholic
beverages allowed in boat during tournament hours.
4. If a contestant is disqualified for rules violation, all other contestants
in the boat will also be disqualified.
5. You may launch from anywhere on Lake Dardanelle. Do not cast
your line before 6:00 a.m. on either day. Weigh-ins will begin at
8:00 a.m. and at the top of each hour until1:00 p.m. You must be
in weigh-in line before the top of each hour or by 1:00 p.m. for your
catch to count. Fishing is limited to Lake Dardanelle,
no locking through.
6. No contestant is permitted to fish nearer than 50 yards of another
tournament boat, which is anchored or tied.
7. No fishing is allowed within 200 yards of the weigh-in site. Defined
as the entire area within the no wake buoys at Russellville State
Park, Lake Dardanelle. The no wake zone will be strictly enforced.
8. Only largemouth, smallmouth and Kentucky spotted bass
(15 inches or longer), judged capable of surviving will be weighed.
You may trailer your boat to weigh-in site.
9. Dead fish will not be weighed.
10. You must personally weigh-in your fish.
11. All fishing will be done with a rod and reel and artificial lures only.
Pork rind is acceptable. No trolling.
12. A non-contestant can ride in the boat, but cannot fish or assist
the contestant in any way.
13. Each contestant is allowed to have total of two (2) fish in their
possession at any given time. Fish entered in the hourly contest
do not carry over from hour to hour but are eligible to win overall
payback prize money. You can only win one place in
overall standings.
14. You can only weigh-in one (1) fish per tournament hour.
15. In case of ties in the hourly weigh-in, the fish weighed in first will
be the winner.
16. $10,000 guaranteed for the largest bass of the tournament.
Based on 200 entries each day.
17. In case of a tie in the overall standing, the first fish weighed
will count as the tiebreaker for first place.
18. Fish must be weighed in on the day it is caught.
19. No personal checks will be accepted after April 19th.
20.Each contestant, by signing the entry form, agrees to submit
to polygraph testing and/or drug screen.
21.All fish weighed-in will become property of the tournament
director and will be released back healthy to Lake Dardanelle.
22. A certified company will randomly give polygraph tests for
tournament integrity to all prizewinners. Contestants must
pass these tests.
23. All announcements concerning the tournament will be
broadcast on KCJC 102.3.
24.Target weight sponsor prizes – Four (4) target weights per day
for sponsor prizes. Must hit exact weight or prize will roll over to
the next target weight hour. If target weight is not hit, payout to
the closest at the end of each day.
25.Entry fees are non-refundable.
26.The tournament rules will remain unchanged. Interpretation of
these rules shall be left exclusively to the tournament rules
committee. The decisions of the tournament officials shall be
final in all matters.
27. All prizewinners will be responsible for all local,
state and federal taxes.
28. The tournament sponsor, officers, employees, agents, etc.
will not be responsible for boating or water accidents.
Each tournament contestant shall be solely responsible for
his/her actions with regards to inclement weather or other
potentially dangerous situations which may arise. The contestant
or non-contestant expressly assumes the risk of any and all
damage or injury of any nature, which may result from any
source whatsoever during the tournament. Should any contestant
be a minor, a parent or legal guardian shall grant such release
on part of the minor.
29. All tournament contestants must read and sign the form entitled
“WAIVER & RELEASE”. Your signature on this form will constitute
a certification that the contestant has read and understood all
terms set forth.
30. All tournament contestants by their entry applications shall grant
permission to the tournament sponsors the right to publicize and/or
broadcast his/her name. If participant is a minor (under age 18) a
parent or legal guardian shall be required to grant permission
on entry form.
31. All prize money will be awarded shortly after 2:00 p.m. Sunday,
